USCIS Will Accept H-1B Visa Applications for 2015 Starting in April 2014

Starting on April 1, 2014, the U.S. Citizenship and Immigration Services (USCIS) will be starting to accept H-1B visa petitions for the 2015 year. Applicants for these visas should be aware that, according to the USCIS:

  • The postmarked date of these applications will not be taken into consideration. Only the date on which the USCIS receives the application will matter for review purposes.
  • In order to be reviewed, H-1B applications must be properly filled out and must be submitted with the appropriate application fees.
  • There is a congressionally mandated cap on H-1B visas for 2015. This cap is 65,000 visas, with the first 20,000 H-1B applications received by the USCIS for applicants who have a U.S. master’s degree (or a greater degree) being exempt from the cap.

H-1B Visa Cap Will Be Met by April 7th, USCIS Officials Expect

Given the cap on these visas, as well as the fact that there has historically been a high demand for them, the USCIS expects the caps (both for the 20,000 exemptions and the 65,000 H-1B visa applications) to be met by April 7th. In its recent press release, the USCIS also clarified that a random selection process will be used to pick applications to satisfy both caps.

Once the caps for the H-1B visas have been met, all excess applications filed for this review will be rejected and returned with the accompanying fees to the applicants.

Processing of the H-1B visa applications seeking visas for 2015 will begin no later than April 28, 2014, and USCIS officials have strongly urged all applicants to make sure that they supply all necessary evidence for review to expedite the process (and to reduce the chances that the USCIS will need to come back and request additional evidence).
